180647 Bragg Hill Corp. v. City of Fredericksburg 08/15/2019 In a landowner's declaratory judgment action on zoning issues, the circuit court did not err in dismissing all of the claims. A change in the zoning of the property upon its annexation by the city was not void ab initio because it was authorized by the city's zoning ordinance and by the Virginia Code. Whether the landowner had a vested right to develop the land in accord with prior zoning provisions -- based on pre-annexation approval by the county planning commission of a revised development master plan -- was decided against the landowner in 2009 by the zoning administrator and that disposition was affirmed by the BZA.
