Commonwealth 10/31/2014 When a defendant charged with possession of heroin with the intent to distribute in violation of Code § 18.2-248 asked for a continuance on the morning of trial to obtain other counsel, the circuit court did not violate his Sixth Amendment rights by denying him a continuance sought for the purported purpose of substituting counsel of his choosing for the court appointed counsel who was present and ready to proceed with trial. The judgment of the Court of Appeals upholding the conviction is affirmed.
