Commonwealth 10/31/2008 (Revised 04/06/2009) In a prosecution on drug possession and distribution charges, along with a related firearms possession offense, the trial court and the Court of Appeals sitting en banc erred in rejecting a motion to suppress evidence seized from a motorist's car that was stopped based upon an officer's observation that an inspection sticker on the windshield was peeling. Under all the circumstances of this case, the officer's suspicion that the driver was violating the motor vehicle inspection law was insufficient grounds for stopping the vehicle, and the fruits of the search that followed should have been suppressed.
