Consolidation Coal Co. 06/06/2008 In a dispute between a mineral estate owner and a competing mining company, the trial court erred in concluding that the competitor had the right to store excess water from its mining operations on other property, and erred in denying injunctive relief. Since the deed did not convey the right to use the mineral estate to support mining operations on other lands, the lease in this case could not confer such a right and the purported authorization to do so was invalid.
