Board of Zoning Appeals of Falls Church 02/29/2008 In a dispute concerning whether the initial decision of a board of zoning appeals to grant a variance allowing a nonconforming structure to be enlarged and extended converts that structure into a conforming use for subsequent zoning ordinance applications, the circuit court did not err in ruling that the variance did not result in the plaintiffs' property becoming a conforming use. The court also correctly determined that the plaintiffs failed to establish that they had a vested right to continue the nonconforming use of their property after the existing structure had been completely demolished to its foundation.
