Young 11/01/2002 The circuit court erred in dismissing a prisoner's petition for a writ of habeas corpus averring that he was denied effective assistance of counsel when trial counsel failed to object to an instruction that allowed the jury to find the petitioner guilty even if the Commonwealth failed to prove beyond a reasonable doubt each element of the charged offense. Because counsel's performance was deficient and prejudiced the defense, the order is reversed and the proceeding is remanded.
