Comerci 06/07/2002 In a wrongful death action arising from alleged medical negligence, the circuit court erred in granting a contributory negligence instruction and in precluding cross-examination of a defense expert concerning prior testimony for, and compensation from, the defendant, but did not err in granting an instruction on mitigation of damages. The judgment is reversed and the case remanded for a new trial.
