Commonwealth 03/01/2002 In a capital murder prosecution which led to a sentence of death, the trial court erred, as a matter of law, by failing to apply the proper test and failing to consider the necessary factors when making its decision to deny the defendant's motion to change venue because of extensive pretrial publicity. Other issues are addressed. The judgment of conviction is vacated and the case is remanded. (Opinion edited 5/1/02)
