Charles 06/09/2000 In a wrongful death action, the circuit court did not err in striking a contributory negligence defense because defendant's testimony was not corroborated as required by Code § 8.01-397, but did err in denying a motion for new trial on the issue of damages because the jury verdict was only for the exact amount of the decedent's funeral expenses.
