Williams 11/04/2010 (Revised 05/23/2011) In a medical malpractice action against the estate of a deceased doctor, a nurse who gave testimony for the plaintiff as a non-party witness at trial was not an "interested party" whose testimony required corroboration under Code § 8.01-397. Thus there is no error in the circuit court's denial of the defendant's motions to strike or its refusal to instruct the jury on the Dead Man's Act. Judgment for the plaintiff is affirmed.
