Snead v. C&S Properties

REVERSED status graphic: Snead v. C&S Properties. 090524 Snead v. C&S Properties 04/15/2010 In an injunction proceeding arising from allegations that an easement was subject to encroachment, the trial court erred in refusing permanent injunctive relief upon a finding that the encroachment was not a material interference with the dominant owners' rights because vehicular access remained possible. The judgment is reversed and the case is remanded for entry of permanent injunctive relief barring encroachment on the full width of the easement.
