Logan v. Commonwealth

UPHELD status graphic: Logan v. Commonwealth. 090706 Logan v. Commonwealth 01/15/2010 In accord with prior case law, the exclusionary rule is not applicable in probation revocation proceedings absent a showing of bad faith on the part of the police. The judgment of the Court of Appeals, which upheld the probation revocation order in the present case, is affirmed, but its opinion in this case is overruled to the extent that it suggests that prior case law has been to any extent changed.
