Commonwealth 03/01/2002 In a criminal case, the trial court abused its discretion in finding that the trial testimony of two frightened witnesses was "unavailable" and thereafter admitting their prior testimony from a preliminary hearing. The judgment of the Court of Appeals upholding the judgment of conviction in the trial court is reversed. The case will be remanded for a new trial if the Commonwealth be so advised.
