Langley School 11/06/1998 In a contract case for payment of school tuition, the circuit court erroneously entered summary judgment for the school before permitting the parents to conduct discovery with regard to their defense that a liquidated damages clause in the contract was an unenforceable penalty. The judgment is reversed and the case remanded.
